1. GENERALITIES
1.1 BATTLE OF SONGS is an international songwriting contest initiated in 2007 dedicated to music creators: composers, songwriters and / or instrumentalists.
1.2. The organisation and all the rights arising from the BATTLE OF SONGS contest, belong to SC Star Management SRL.
1.3. The contest BATTLE OF SONGS is open for worldwide composers, amateurs or professionals.
1.4. BATTLE OF SONGS is a contest with prizes consisting in money and / or products.
1.5. Each song must be the original creation of the contestant. The songs may have one or more composers. The prize shall be granted to the person or persons mentioned in the registration form.
1.6. Songs that belongs to all musical genres can be registered only if the author/authors sign a publishing contract or a sub-publishing contract with Star Management.
1.7. The length of the song shall not exceed 4 minutes.
1.8. The contestants are entitled to register an unlimited number of songs.
1.9. The authors must have a written consent of all the copyrighter holders that are connected with the song (soloists, instrumentalists etc.)
1.10. The lyrics of the song may be in any language but, if it is not in the Romanian or English language, must have a translation into the English language that shall be sent once with the song.
1.11 It is recommended that the recording and the performance of the song to be of the best quality.
1.12 The songs that contain obscene lyrics and/or licentious expressions shall not be accepted.
2. CONTES’S STAGES
2.1. The songs registration period into the contest is 1st of August – 5th of October 2011 (deadline).
2.2. Judging the songs registered into the contest shall take place during 5th of October – 14th of October 2011. The grades resulted following the average mark shall not be announced to the public.
2.3. Announcement of the song that are in the semi-final (maximum 30 songs): 15th of October 2011.
2.4. First voting session by SMS in order to nominate the songs that are going into the final: 16th of October – 2nd of November 2011. The votes expressed by SMS shall be reflected into the ranking of the www.battleofsongs.com. The first 12 ranked shall enter into the final, in the race for the Popularity Prize.
2.5. Also, based on the number of votes obtained by SMS, of those 12 songs that enter into the final: 2nd of November – 7th of November 2011.
2.6. Second voting session by SMS in order to nominate those 6 (six) songs that enter into the race for winning the Popularity Prize, in amount of 1.000 Euro, shall take place during 8th of November – 3rd of December 2011.
2.7. Announcement of the Big Prize winner, in amount of EUR 5000 shall take place on the 5th of December 2011.
2.8. The Awarding Ceremony shall take place on the 11th of December 2011.
3. PIZES
3.1. The Big Prize of BATTLE OF SONGS, in amount of EUR 5000, shall be granted to a composer (or composers) exclusively based on the grades given by the jury members. The winner shall be announced on the 5th of December 2011.
3.2. The song that shall receive more of votes by SMS from the public shall be rewarded with the Popularity Prize BATTLE OF SONGS, in amount of EUR 1000. The Popularity Prize BATTLE OF SONGS is granted only based on the votes expressed by SMS.
3.3. It is the winners’ responsibility to pay all the fees and the taxes due to the received amounts. BATTLE OF SONGS shall report all the money allocated in prizes. It is the contestant responsibility to investigate and to comply with the law. All the Romanian laws are applicable.
4. JURY
4.1. The decision of the jury is incontestable.
4.2. Star Management reserves the right to have the final decision in arbitrament/judging in case it occur any type of problem, misunderstanding or other unforeseen events.
4.3. The public shall have a number on which a sms message could be sent. A sms = a vote.
5. REGISTRATION
5.1 In order to register a song into contest, there are two options to pay the registration fee: bank payment (payment order) or payment by SMS.
5.2 Bank payment
a) The registration fee is of EUR 10 + VAT (as of EUR 12,4) may be paid by card or by bank transfer, in one of the accounts that are dedicated to the contest:

- RO30BRDE441SV72685024410 – USD (for the contestants from other countries than Romania swift brderobu)
b) Details regarding the bank payment are available on the Registration section on the site www.battleofsongs.com.
5.3 Payment by SMS
The registration fee is of EUR 10 + VAT (as of EUR 12.4 Euro). Details regarding the payment by SMS are available on the Registration section on the site www.battleofsongs.com.
5.4 In case the payment of the registration fee is made in other currency than Euro, its amount shall be calculated according to the exchange rate settled in the payment day by the National Bank of Romania.
5.5 The registration fee is not refundable.
5.6 A song is considered registered into contest if the following criteria are fully respected:
- The registration fee was paid and the proof of this payment is made;
- The song author/authors signed and sent to Star Management:
a) It is filled in and signed the publishing contract or sub-publishing contract. If the same authors register more songs, these shall be registered in Annex 1 of a single contract.
b) A copy of the hereby Rules, signed by all authors of a song
c) A photocopy of the declaration of the musical work (if the song was registered previously to the registration into the contest at copyright collecting society form the country of song writer)
- The name of the registered song shall be saved still from the project of the program of publishing the music used by the contestant
- The registration form is filled in with all the data from the identity card;
- It is attached the translations of the lyrics in the English language, if those are written in other language than Romanian or English;
- If the payment by SMS or the payment by bank was made according to the procedures detailed at the Registration section on the site www.battleofsongs.com.
- The song in audio format audio (wav) was uploaded according to the requirements on the Registration section on the site www.battleofsongs.com.
5.7. The registration formalities are considered complete in the moment in which the contestant sends to the organiser, in 5 (five) working days from the finalisation of the procedures stated on the Registration section on the site www.battleofsongs.com, but no later than 5th of October 2011, a envelope which contains:
a) The documents filled in and signed: the registration sheet, a photocopy of this Rules, the publishing contract or the sub-publishing contract, the declaration of the musical work (document of copyright collecting society form the country of song writer), translations of the lyric (if is necessary).
b) A audio CD with the registered song or songs (do not send the master!!!)
c) The consent signed by all persons that are connected, in case they are instrumentalists, soloists, backing vocals, signed in original copy shall be sent together with the publishing contract and the signed rules.
The envelope shall be sent only by fast courier companies (DHL, Pegasus, Cargus etc.) at the address STAR MANAGEMENT, bdul Octavian Goga nr. 12, bloc M23, scara B, etaj. 2, ap. 32, sector 3, Bucuresti. The envelopes that are sent by classic post office mail shall not be taken into account!
5.8. In case a contestant registers more songs, and the paid fee by bank to the organiser BATTLE OF SONGS does not have the correct value (as of EUR 12.4 x number of songs), BATTLE OF SONGS shall accept into the contest only the songs of which registration was covered by the paid fees, in the chronological order of the registration.
5.9. BATTLE OF SONGS is not responsible for the deterioration or the loss of the CDs sent by courier.
5.10. The contestants with the age under 18 years need the signature of one of the parents or the signature of the legal guardian on all the original documents necessary to the registration of the songs into the contest.
5.11. Star Management SRL as organiser of the contest has no responsibility in case the authors register songs that contain fragments of the already existing works or that breach other provisions of the laws regarding copyrights or other rights of intellectual property.
5.12. The songs registered into the contest cannot be withdrawn.
5.13. The winners and the finalists shall be contacted after the results of each stage shall be published/announced, in maximum 5 (five) days from the announcement of these results.
6. PROMOTION
6.1 The registered composers shall help entirely the organiser in order to promote his/her own songs and for the contest BATTLE OF SONGS.
6.2 Each registered composer shall provide to Star Management a CV and 3 recent photographs in jpeg format.
6.3 Within 5 days from Star Management request interviews on the site www.battleofsongs.com, on other sites and other formats.
7. INCOMES
- The incomes results following the commercial exploitation of any kind of the songs registered in the contest BATTLE OF SONGS shall be divided according to the provisions of the publishing contracts and/or sub-publishing contracts signed by STAR MANAGEMENT with the authors (copyrights and singer rights).
STAR MANAGEMENT is entitled to change these rules at any time, without a previous notice.
